Terms of Service
Effective Date: May 2026
Welcome to Pair Mobility. These Terms of Service ("Terms") govern your access to and use of the Pair platform, including our mobile application, website, and all related services (collectively, the "Service"). By registering for or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of them, you must not use the Pair platform.
1. About Pair
Pair Mobility ("Pair", "we", "our", "us") operates a route-based shared commuter service in Lagos, Nigeria. Our platform enables passengers to book seats on scheduled, air-conditioned minivans travelling along fixed high-demand corridors. Pair is a booking and technology platform; our drivers and vehicles are independently verified partners operating under contract with Pair.
2. Eligibility
To use the Pair platform, you must:
- Be at least 18 years of age
- Have a valid Nigerian phone number capable of receiving SMS
- Have access to a Nigerian bank account or card for payment processing
- Provide accurate and truthful information during registration
- Not have been previously suspended or permanently banned from the Pair platform
By creating an account, you represent and warrant that you meet all eligibility requirements listed above. Pair reserves the right to terminate accounts found to be in violation of these requirements.
3. Account Registration & Responsibilities
When you register for Pair, you agree to:
- Provide accurate, complete, and up-to-date personal information
- Submit a clear selfie/headshot photograph for identity verification purposes
- Keep your login credentials confidential and not share them with any other person
- Notify Pair immediately if you suspect any unauthorised access to your account
- Take responsibility for all activity that occurs under your account
Pair reserves the right to suspend or terminate your account if we have reason to believe your account information is false, inaccurate, or used in a manner that violates these Terms.
4. Booking & Payments
4.1 Booking: Seats on Pair minivans must be booked in advance through the Pair mobile app or web app. Bookings are confirmed only upon successful payment. Walk-on passengers are not permitted.
4.2 Seat Guarantee: Once your booking is confirmed and payment has been received, your seat on the specified trip is guaranteed, subject to circumstances beyond Pair's control (see Section 9).
4.3 Pricing: Fares are displayed in the app prior to booking confirmation. Pair reserves the right to adjust pricing at any time. Price changes will not affect already-confirmed bookings.
4.4 Payment Processing: All payments are processed through Paystack. By making a payment, you also agree to Paystack's terms and conditions. Pair does not store your card or bank details.
4.5 Pair Wallet: Refunds and credits are issued to your Pair Wallet. Wallet credits may be used against future bookings on the platform and have no cash value.
5. Cancellations & Refunds
The following cancellation and refund policy applies to all bookings:
- Cancellation more than 2 hours before departure: Full refund to Pair Wallet
- Cancellation less than 2 hours before departure: 50% credit to Pair Wallet
- No-shows (failure to board at scheduled departure time): No refund
If Pair cancels a trip for any reason attributable to Pair (e.g. vehicle unavailability, driver no-show), passengers will receive a full refund to their Pair Wallet or, where possible, be offered an alternative trip at no additional cost.
Refund requests relating to exceptional circumstances (medical emergencies, bereavement) will be assessed on a case-by-case basis. Contact support@pairmobility.com within 48 hours of the affected trip.
6. Passenger Code of Conduct
All Pair passengers are expected to maintain a safe, respectful, and comfortable environment for fellow passengers and drivers. When using the Pair service, you agree to:
- Arrive at your designated pickup point at least 5 minutes before scheduled departure
- Treat fellow passengers and drivers with respect at all times
- Not consume alcohol, smoke, or use illegal substances during a Pair trip
- Not engage in conduct that is threatening, abusive, or harassing
- Keep noise levels reasonable and respect the comfort of co-passengers
- Not request the driver to deviate from the assigned route
- Comply with any reasonable safety instruction from the driver
Pair reserves the right to remove passengers from the platform without refund for violations of this code of conduct, including behaviour reported by drivers or verified by in-trip data.
7. Identity Verification & Safety
7.1 Facial Verification: Pair will use facial recognition technology to verify that the person boarding matches the registered account holder.
7.2 Driver Verification: All Pair drivers undergo background checks and onboarding before being approved to operate. Pair does not guarantee that drivers are employees of Pair; they are independent contractors operating under a service agreement.
9. Service Disruptions & Force Majeure
Pair will make reasonable efforts to operate all scheduled trips on time and as booked. However, Pair shall not be held liable for delays, cancellations, or service interruptions caused by circumstances beyond our reasonable control, including but not limited to:
- Severe traffic conditions, road closures, or government-imposed restrictions
- Natural disasters, flooding, or extreme weather events
- Vehicle breakdowns (where a reasonable substitute cannot be sourced in time)
- Acts of government, civil unrest, or force majeure events
In such cases, Pair will use its best efforts to notify affected passengers promptly and to issue appropriate credits or alternative arrangements.
10. Limitation of Liability
To the fullest extent permitted by applicable Nigerian law:
- Pair is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
- Pair's total liability to you for any claim arising from your use of the Service shall not exceed the fare amount paid for the specific trip to which the claim relates
- Pair does not guarantee that the Service will be uninterrupted, error-free, or available at all times
- Pair is not liable for the acts or omissions of independent drivers beyond what is covered by the driver service agreement
Nothing in these Terms excludes or limits Pair's liability for death, personal injury, or fraud caused by Pair's negligence, or any other liability that cannot be excluded under Nigerian law.
11. Intellectual Property
All content, branding, software, and materials on the Pair platform - including the Pair name, logo, app design, and route data - are the intellectual property of Pair Mobility and are protected under applicable Nigerian and international intellectual property law. You may not reproduce, distribute, or create derivative works from any Pair content without our express written permission.
12. Termination
Pair reserves the right to suspend or permanently terminate your account at any time, without notice, for the following reasons:
- Violation of these Terms of Service
- Provision of false or misleading registration information
- Engaging in conduct that endangers the safety of drivers or co-passengers
- Repeated cancellations or abuse of the refund system
- Any activity that Pair reasonably believes to be fraudulent or unlawful
You may close your Pair account at any time by contacting support@pairmobility.com. Account closure does not entitle you to a refund of any Pair Wallet credits. Upon closure, your data will be handled in accordance with our Privacy Policy.
13. Amendments to These Terms
Pair may update these Terms of Service from time to time to reflect changes in our service, legal requirements, or business practices. When material changes are made, we will notify you via the app with at least 7 days' notice before the new Terms take effect.
Continued use of the Pair platform after the effective date of any revised Terms constitutes your acceptance of those changes.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to mediation or arbitration in Lagos, Nigeria, under applicable Nigerian arbitration rules.
